Terms of Service

Last updated: 21 August 2026 Effective date: 21 August 2026

1. Who we are

Mibboo is a product of AOGEN PTY LTD (ABN 33 686 852 871, ACN 686 852 871), an Australian private company with its principal place of business at 115 Pitt Street, Sydney NSW 2000, Australia.

In these Terms, “Mibboo”, “we”, “us” and “our” refer to AOGEN PTY LTD.

You can contact us at info@mibboo.com. For corporate or legal notices, you may also write to info@aogen.com.au.

These Terms of Service (“Terms”) govern your access to and use of the Mibboo platform, websites, applications and related services (together, the “Service”).

By creating an account, accessing or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and “you” refers to that entity.

If you do not agree to these Terms, do not use the Service.

2. What the Service does

Mibboo is a hiring platform that helps employers:

  • generate role-specific application forms using artificial intelligence;
  • publish those forms on a Mibboo subdomain (for example, yourcompany.mibboo.com);
  • collect applications from candidates;
  • receive AI-assisted analysis and ranking of applications to support human review.

Mibboo does not make hiring decisions. All AI output is decision-support information only. See section 9.

3. Accounts and organisations

3.1 Account registration

You must provide accurate information when creating an account and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must be at least 18 years old and legally capable of entering into a binding contract.

3.2 Organisations and roles

The Service is organised around “Organisations”. When you complete onboarding, an Organisation is created and you become its Owner.

Organisations may have members with different roles (Owner, Admin, Editor, Viewer), each carrying different permissions. The Owner is responsible for managing members, permissions and, where applicable, billing.

You are responsible for the actions of all members of your Organisation.

3.3 Email verification

Certain features, including publishing a form, require a verified email address.

4. Your subdomain

When you create an Organisation you select a subdomain identifier (the “Slug”), which forms part of a Mibboo-hosted address such as yourcompany.mibboo.com.

You agree that:

  • you will not select a Slug that infringes a third party’s trade mark or other rights, impersonates another business, or is offensive, misleading or unlawful;
  • certain Slugs are reserved by us and unavailable;
  • we may reclaim, suspend or change a Slug where we reasonably believe it breaches these Terms, infringes third-party rights, or is required by law;
  • the Slug does not grant you ownership of any domain name or any rights in the mibboo.com domain.

If you change your Slug, we will maintain redirects from the previous address for a reasonable period, but we cannot guarantee that links published on third-party platforms will continue to work.

5. Plans, limits and fair use

5.1 Free plan

The Service is currently offered on a free plan with monthly usage limits, which may include limits on the number of forms you may publish, the number of AI interactions available to you, and the number of applications automatically scored.

Current limits are shown in the Service. We may change these limits with reasonable notice.

5.2 Applications are never blocked

Reaching a usage limit does not prevent candidates from submitting applications. If you exceed a limit, applications continue to be accepted and stored, but AI scoring may be paused until your usage resets or you upgrade. We do this so your published job advertisements continue to work and candidates are not turned away.

5.3 Paid plans and GST

We may introduce paid plans. If you subscribe to a paid plan, additional terms relating to fees, billing cycles, taxes and cancellation will apply and will be presented to you before you subscribe.

AOGEN PTY LTD is registered for GST. Prices displayed to customers in Australia are inclusive of GST unless stated otherwise. Prices displayed to customers outside Australia are exclusive of any local taxes, which are your responsibility.

5.4 Fair use

You must not use the Service in a way that places an unreasonable or disproportionate load on our infrastructure, attempts to circumvent usage limits, or interferes with other customers’ use of the Service.

6. Data roles and responsibilities

6.1 You are the controller of candidate data

For personal information relating to candidates who apply through your forms:

  • you determine the purposes for which that information is collected and used, and are the data controller (or equivalent) under applicable law;
  • Mibboo processes that information on your behalf and in accordance with your instructions, as a data processor (or equivalent).

6.2 Your responsibilities as controller

You are responsible for:

  • having a lawful basis to collect and process candidate information;
  • providing candidates with any required privacy notice or collection statement;
  • responding to candidate requests to access, correct, delete or object to the processing of their information (we will provide reasonable assistance and tooling);
  • determining and configuring an appropriate data retention period;
  • complying with all applicable employment, anti-discrimination, privacy and data protection laws in every jurisdiction in which you advertise, recruit or hire — including the jurisdictions where your candidates are located;
  • ensuring any cross-border transfer of candidate information arising from your use of the Service has a lawful basis under the laws applicable to you.

6.3 Our responsibilities as processor

We will:

  • process candidate data only on your documented instructions and as needed to provide the Service;
  • apply the technical and organisational security measures described in our Privacy Policy;
  • notify you without undue delay if we become aware of a data breach affecting your data;
  • make available an export of your data and delete it in accordance with section 12;
  • maintain a current list of sub-processors and give notice of material changes.

6.4 Data processing agreement

Where required by applicable law, we will enter into a separate data processing agreement with you. Contact info@mibboo.com.

7. Acceptable use

You must not, and must not permit any person to:

  • use the Service for any unlawful purpose or in breach of any applicable law;
  • publish job advertisements or application forms that are fraudulent, misleading, or advertise roles that do not exist;
  • collect information from candidates that is unlawful to collect in the relevant jurisdiction, or ask questions that discriminate on the basis of a protected attribute (including but not limited to race, colour, ethnicity, national origin, religion, sex, gender identity, sexual orientation, marital or family status, pregnancy, age, disability or political opinion);
  • use the Service to harvest candidate information for purposes unrelated to a genuine recruitment process;
  • upload or transmit malicious code, or attempt to gain unauthorised access to the Service, other customers’ data, or our systems;
  • reverse engineer, decompile or attempt to derive the source code of the Service, except to the extent this restriction is prohibited by law;
  • resell, sublicense or make the Service available to third parties other than your Organisation’s members, except as expressly permitted;
  • use the Service to develop a competing product, or to train a machine learning model on outputs of the Service;
  • circumvent or attempt to circumvent any usage limit, rate limit or security control.

We may suspend or terminate access where we reasonably believe this section has been breached.

8. Candidate-facing obligations

Because candidates interact with forms you publish, you additionally agree that:

  • you will not use the Service to contact candidates for purposes they have not been informed of;
  • you will honour any consent choices a candidate makes in your form (for example, consent to be retained in a talent pool);
  • you will not require a candidate to opt into Mibboo’s or your own talent pool as a condition of submitting an application;
  • you will keep acknowledgement of a privacy notice separate from optional consent choices and will not describe a bundled or undefined permission as consent;
  • you will not represent that Mibboo makes hiring decisions or endorses any candidate.

9. Artificial intelligence — important limitations

9.1 Decision support only

The Service uses artificial intelligence to generate application forms and to analyse and rank applications. AI output is advisory only. It is provided to support human judgement, not to replace it.

9.2 You must apply human review

You agree that:

  • you will not make any adverse hiring decision — including rejecting, screening out or declining to progress a candidate — solely on the basis of automated processing;
  • a qualified human will review AI-generated scores, rankings and analysis before any decision affecting a candidate is made;
  • you will inform candidates that AI-assisted evaluation is used, where required by applicable law or where reasonably expected;
  • you remain solely responsible for all hiring decisions.

9.3 No warranty of accuracy

AI output may be incomplete, inaccurate, inconsistent or unsuitable for your purpose. AI models can produce different results for similar inputs. We do not warrant that AI output is accurate, unbiased, predictive of job performance, or compliant with the law applicable to you.

9.4 Regulated jurisdictions

Some jurisdictions impose specific obligations on the use of automated tools in employment decisions, which may include candidate notice requirements, independent bias audits, or a right to human review. You are responsible for determining whether such obligations apply to you and for complying with them. We will provide reasonable assistance and, where available, data to support any audit you are required to conduct, but we cannot perform that audit on your behalf.

10. Intellectual property

10.1 Our rights

AOGEN PTY LTD and its licensors own all rights in the Service, including the platform, software, models, prompts, scoring methodology, design, documentation and the Mibboo name and branding. Nothing in these Terms transfers any of those rights to you.

10.2 Your rights

You retain all rights in the content you submit to the Service and in candidate data collected through your forms (“Customer Data”).

You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, transmit and display Customer Data solely to provide, secure and support the Service.

10.3 Aggregated data

We may generate and use aggregated and de-identified data derived from use of the Service to operate, analyse and improve the Service. Such data will not identify you, your Organisation, or any candidate. We do not use Customer Data containing personal information to train machine learning models.

10.4 Feedback

If you provide feedback or suggestions, you grant us an unrestricted right to use them without obligation to you.

11. Third-party services

The Service relies on third-party providers, including cloud hosting, AI inference, email delivery and network infrastructure. A current list is available in our Privacy Policy.

We are not responsible for the acts or omissions of third-party services you separately choose to connect to or use alongside the Service.

12. Term, suspension and termination

12.1 Term

These Terms apply from the date you first access the Service until terminated.

12.2 Your right to terminate

You may stop using the Service and delete your Organisation at any time from within the Service or by contacting us.

12.3 Our right to suspend or terminate

We may suspend or terminate your access, with or without notice, where:

  • you materially breach these Terms;
  • your use creates a legal, security or reputational risk to us or others;
  • we are required to do so by law;
  • your account has been inactive for an extended period, following reasonable notice.

12.4 Effect of termination

On termination:

  • your access to the Service ends;
  • you may export your data for 30 days after termination;
  • after that period, we will delete your data in accordance with our Privacy Policy and retention practices, except where retention is required by law;
  • candidate applications keep their existing retention deadline; only an application for which the candidate separately opted into Mibboo’s private talent pool may be retained by Mibboo for that purpose, for no longer than the period stated in the Privacy Policy;
  • backups containing your data will age out on our normal backup cycle. Where we hold encryption keys specific to your data, deletion of those keys renders the data unreadable.

Sections that by their nature should survive termination (including sections 10, 13, 14 and 16) will survive.

13. Warranties and disclaimers

To the maximum extent permitted by law, and subject to section 14:

  • the Service is provided “as is” and “as available”;
  • we do not warrant that the Service will be uninterrupted, error-free, or that it will meet your requirements;
  • we do not warrant any particular hiring outcome, response rate, or candidate quality;
  • we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

The free plan is provided without any service level commitment.

14. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other applicable law that cannot lawfully be excluded.

Where our liability for a failure to comply with a consumer guarantee can be limited, our liability is limited, at our option, to resupplying the services or paying the cost of having the services resupplied.

15. Limitation of liability

Subject to section 14, to the maximum extent permitted by law:

  • neither party is liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, business opportunity or data;
  • our total aggregate liability arising out of or in connection with these Terms or the Service is limited to the greater of (a) the total fees you paid to us in the twelve months preceding the event giving rise to the claim, or (b) AUD $100.

These limitations apply regardless of the theory of liability and even if a party has been advised of the possibility of such damages.

16. Indemnity

You will indemnify and hold us harmless from any claim, loss, liability, damage or expense (including reasonable legal costs) arising from or in connection with:

  • your breach of these Terms;
  • your Customer Data, including any claim that it infringes third-party rights or was collected or used unlawfully;
  • any hiring decision you make;
  • any claim by a candidate relating to your collection, use, disclosure or retention of their personal information;
  • your failure to comply with any employment, anti-discrimination, privacy or data protection law applicable to you.

17. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will give you reasonable notice — by email or through the Service — before the change takes effect.

Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, you must stop using the Service.

18. General

Governing law. These Terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.

Entire agreement. These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between us regarding the Service.

Severability. If any provision is found unenforceable, the remaining provisions continue in full force.

No waiver. A failure to enforce any provision is not a waiver of the right to enforce it later.

Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition or sale of assets.

Force majeure. Neither party is liable for a failure to perform caused by an event beyond its reasonable control.

Notices. We may give notice by email to the address associated with your account or by posting in the Service. You may give notice to info@mibboo.com or, for corporate and legal notices, info@aogen.com.au.
